Stearns is full of nonsense! Federal bank regulators require a bank to keep 5% capital to assets to be "well capitalized" and a bank isn't in danger of being seized until it falls below 2%.

Gibraltar can easily pay $100 million and remain well capitalized. But why expect them to start telling the truth now?
