Circuit Judge Maria Espinosa Dennis is seeking a second opinion — after the Miami-Dade state attorney’s office decided not to prosecute on her allegation that fellow Circuit Judge David Miller assaulted her in the courthouse. Dennis’ attorney, Joel Hirschhorn of Hirschhorn & Bieber in Coral Gables, wrote Gov. Charlie Crist on Friday asking him to appoint an outside prosecutor to evaluate the case "to preserve public confidence in our judicial system and properly serve the ends of justice" against what Hirschhorn termed "violent, unprovoked criminal conduct." The letter stems from a contentious turn of events over the use of a fax machine Oct. 7. Dennis contends Miller grabbed her and attempted to push her into her office after her staff told him he couldn’t use her office fax machine. She pressed her "panic button," and police arrived at the scene. Chief Judge Joseph Farina later moved Miller to a different floor and reassigned him to family court as part of a regular rotation of judicial assignments. Assistant State Attorney Joseph Centorino dropped the case last month, but Hirschhorn wants it re-examined. "This is a serious matter which should be reviewed by an independent, apolitical prosecutor from a county other than Miami-Dade," he wrote.
