The decision from the Third District Court of Appeal was issued on a Tuesday instead of the customary Wednesday.
But even more notable was its author: The ruling was Judge Thomas Logue's first written opinion.
Sunbeam Television Corp. asked the court to issue a stay pending appeal in its case against Clear Channel Metroplex Inc.
But Logue said in his Oct. 9 opinion that the Rules of Appellate Procedure envision presenting such a motion to the trial court first. Miami-Dade Circuit Judge Jennifer Bailey, he noted, had a status hearing scheduled in the case the following day.
"The idea is that the court most familiar with the controversy is in the best posture to determine the appropriateness and conditions of a stay," wrote Logue, who was named to the court in July.
